Have you been getting letters from the IRS demanding payment on back taxes they claim that you owe? Are you convinced that you do not owe these back taxes or that if you owe them, that the IRS is taking too much from you to allow for living expenses? Do you know what steps to take in dealing with an IRS levy? Do you know how to avoid an IRS wage levy or even an unlawful IRS wage levy?
The IRS is a powerful entity. They have the ability to collect their debts in ways that most other creditors simply can not. One of the most common ways for the IRS to collect is by implementing an IRS levy. This is a general term, meaning that the IRS basically attaches its interest to your assets in order to collect the debt they feel they are owed.
Perhaps the most common form of an IRS levy is the IRS wage levy, which occurs when the IRS contacts your employer to alert them to deduct a portion of every one of your paychecks and to send it to the IRS for payment of taxes owed. Your employer then notifies you of the IRS wage levy, and your pay checks suddenly become smaller until the debt is paid and the IRS is satisfied.
Congress gave the power to the IRS to garnish wages in the form of an IRS wage levy in order to collect past due taxes. However, Congress also placed limits on the IRS as to how much of a person’s income can be seized in order to prevent the delinquent taxpayer to avoid undue financial hardship. What this means in plain English is that the IRS can garnish your wages, but they can not prevent you from being able to provide yourself with basic living expenses such as rent and food.
However, it should also be noted that the IRS is extremely understaffed, and therefore can make mistakes or even abuse its power from time to time. When the IRS goes to far in terms of how much of a person’s income it garnishes, it has put in place what is commonly called an unlawful IRS wage levy. An unlawful IRS wage levy creates nothing but desperation on the part of the taxpayer, as this unlawful IRS wage levy often forces the taxpayer to choose which bills he or she is going to pay. This clearly goes beyond the intended definition of IRS wage levy as laid out by Congress.
